married while VOWA petition is ongoing
I am seeking advice for a friend guys. He has a VAWA petition filed and along the line, got married to someone else who is also abusing him mentally and physically. Can he cancel the first VOWA due to the marriage and fill another VOWA petition?

i would ask a lawyer but i think this particular situation may raise red flags to USCIS. he should not have gotten married while his VAWA was pending, it will void the case. But encourage your friend to talk with a lawyer

yeah he is in a really bad situation, I find it hard to believe that USCIS will actually believe his case. 2 marriages and 2 abuse... that's though to establish legitimacy. time to lawyerup. But his case is weak now.

you just went from preponderance of evidence to clear and convincing evidence. meaning USCIS will have to investigate every piece of evidence in the second case, including contacting all affiants.
