I’m in removal proceedings and I applied for vawa while at a immigration detention center I didn’t get any letter like this matter of fact I got no correspondence from USCIS since I applied 5 months ago. But I do have a lawyer do you have 1?

@Noble Ben have you already applied for vawa and uscis indicated you are eligible to apply for a green card using vawa? Because if that is the case, whatever removal proceeding existed before that is null and void since you can't be deported with a pending vawa application. If this is not the case, you might want to consult a lawyer.

@Kerry S yes with Six prema facie I don’t know why they are asking for the letter of exemption when they already send me letter that I qualify for Vawa. 6PF’s already received

@k jc I have one but he’s so old and I’m trying to get a new lawyer you will get one bcz they usually ask that from those in removal preceding who got married to USA citizen after they been put in removal preceding. However, unless you got married before they put you in removal preceding.

@Noble Ben So my lawyer advised me as soon as I get my prema facie she wants us to go back to the immigration judge and request a cancellation of removal because as she said without that you can’t move forward with your AOS

not yet…I’m number 7 on the list but I’ve seen people with existing vawa file for dismissal and was approved

some layers said you can file an motion to dismiss your removal case when you still waiting for VaWa( risk), my lawyer dismissed my case after my vawa case was approved because he advised if my Vawa was not approve , in the court I still had a change to do AOS, really up to yourself, but file motion is best done by a lawyer not yourself

for the entire court was 5,000 but idk you will need to schedule an appointment so you know how much is your case

@Question Mark i was in court 5 years before my lawyer terminated my proceedings so when he filled it was a wait of 2 months

@reto mont were u married already before they put you in removal preceeding ? or you were in removal preceeding before you got married? I was talking to a lawyer his said my vawa has to be approved before the judge can terminate my removal preceeding.

@Noble Ben i was not married by that time. no, you can get terminated with only prima facie, thats what my lawyer did and i just got aproval on wednesday 17 . in just going to wait for green card

@reto mont ok thanks did you submit letter of exemption during your I-130 petition? bcz they sent me request for RFE for the letter.

@Noble Ben no? i didnt, they called me for an interview for my husband and me, they approved the 130 there at the office. and my husband sign a perdon for it

@Noble Ben I did sent in a letter or exception when I first filed my I-130. I see you’re also in removal proceedings, let me share my experience with you. I was alos in removal but I was able to terminate my case with the court and I just have my vawa pending, so it’s very possible.

they are asking for a letter of exemption because you are under removal and your marriage is less than 2 years. write a statement under oath and tell them your marriage is real.

The new EOIR regulations amending 8 C.F.R. § 1003.18(d) (effective July 29, 2024) give practitioners more flexibility to move for dismissal or administrative closure. For example, where a noncitizen is prima facie eligible for adjustment of status or naturalization before USCIS, a practitioner can file a unilateral motion to dismiss, even where an application is not pending with USCIS. Previously, counsel would have needed OPLA to join the motion, creating a logjam of pending motions for OPLA attorneys to consider.
