Leaving the US whilst i-129/L1B is pending…issues?
My i-129/L1B visa extension is currently pending to be adjudicated and my employer is filing premium processing. My question is, could I leave the US to go home to the UK to see my parents., without it impacting my petition? i expect USCIS will adjudicate the case in 15 days from when they receive the premium orocessing, so well before end December i plan to book an appointment at a US Embassy to get a new visa stamp.

if you have an existing L1 stamp there’s no concern.

do you know approval rates these days?

i’m pretty confident I have a strong case for my extension, I’ve been promoted to Senior level since I first transferred and was able to convey the importance of my role. Hopefully everything goes smoothly and they don’t request an rfe.

Lawyers have specifically filed an extension, should this still allow me to traveo abroad?

if you filed consular processing there is not a problem
R

sorry it’s a silly question, but does consular processing mean?

you can get an extension via USCIS or consular processing. USCIS means it happens within the US via Extension of status. my company only did extension of status this year with so many embassies closed.

my is a L1b extension request through USCIS, so am I correct in saying this shouldn’t have an impact woth my case being adjudicated even if I travelled out of the US? my current L1b expired in May bit an i-129 extension was filed before expiry.

But to come to us you should get your visa stamped in embassy

USA I meant

i see what you mean, yes I’ll have to go to a US embassy. I’m looking at embassies in Europe which have less wait times. are there any strict rules you must go to the embassy in your home country. The London embassy wait times are 60 days for an appointment whereas for example in Frankfurt Germany it’s about a week.

I don’t know about that. I think you can go to any embassy. People go to Canada and get visa stamped.

Yes I think country does not matter

But if you are citizen of UK better to get it from London.

Although I actually got my visa in Belfast, so hopefully it’s not too much of an issue.
