Has anyone got approval from kansas city field office? we had an interview on sept 12, still no update!

My case was denied and I’ve heard about 2 other cases that were denied in Kansas City field office. The 2 cases that were denied, I only know the reason for one case. It was related to an information that he displayed on his labor certification and didn’t write on the i485 application. He filed for a motion to reopen his case, but it was denied for good. The other one was denied recently and he still doesn’t know the reason. I believe he hasn’t received the letter with the explanation yet. Mine was denied bc I had 2 other applications that were denied previously (all with a BDV sponsor. And they were denied based on the sponsor fault, none on mine). Essig is my current sponsor and I worked there for 3 years (until the denial). My interview was on November 2nd. Case was denied on March 2nd. The reason was: on my previous applications I mentioned an old employer (that was within the 5 years of employment history that they request on the form). On my last application this employer was over 5 years, so I didn’t mention it. And that’s the reason they denied me. (Yes, I know, it doesn’t make any sense 🤷🏼‍♀️😕) Envoy has filed a motion to reopen/reconsider my case and it has been over a month since then, with no update. BDV said that they will fight on federal court on my behalf, if the motion is denied tho… So, that’s my update since my interview was completed in November. For now my case is denied and I’m waiting again (which can take around 2 years until I get an answer, if I have to fight on federal court). Frustrating, hard, but I’d like to everyone knows and be prepared. I don’t think that this office is prepared to process EB3- unskilled category.. That’s my opinion.

@Lily C doesn’t look like the office is not prepared. They are looking for ways to deny cases in this category so even if the application was in order they would have looked at something else and denied based on that.Like asking for bank statements since coming to the US, one of the guy I knew got rfed for bank statements and when he submitted it they asked for another rfe asking how he paid his tuition and expenses since Day 1 of landing in the US.

@Haney han he had a US citizen relative who signed a sponsor letter, the relative also provided other supporting documents to be sent to USCIS. No approval yet.

@Mandem FC I have seen people getting approved within 3 months of being current with USCIS only asking for medical rfe. If your case is not apporved within 3 months then its a long wait.There is no rhyme or reason to this madness.

@Mandem FC will be current in May. Buch of people I know got approved with in 3 months of being current where as others ik have been waiting with PD of April, May, June.

@Paan Singh can it not move to a field office and stay at NBC for example, and if so, in that case is an interview also waived, or can you still be interviwed at NBC?

@frost bite NBC sends it to FO for adjudication, your case can’t be at 2 different places at the same time.NBC doesn’t conduct interviews your local FO does.

@Jack jack Unfortunately, I am currently out of status until my case is reopened. If that happens, I will be back in status until a final decision is made. If they do not reopen my case and uphold the denial, I will have to pursue the matter in federal court. In that scenario, my status could be reinstated if the case is ultimately approved and I receive my green card. Until then, I am in a kind of limbo — I cannot work or leave the country. This process may take at least two more years, or possibly longer. I have sold or donated all of my belongings from the life I built here in the United States over the past 10 years with my family (my husband and daughter). I was, and still am, prepared to return to my home country. However, my attorneys (BDV and Envoy) have advised me to wait until the final stage, including a potential federal court decision if necessary. I am honestly exhausted, but I have decided to see this through to the end rather than give up at this point. So now, we will see what happens. I remain prepared to return to my home country at any time once my case is fully resolved, including after a federal court decision if it comes to that. I am already prepared for the worst-case scenario.

They were denied at the I140 stage and I believe that the sponsor received RFE’s before the denial. I started the process in 2019. After both denials (in 2021) BDV offered me another sponsor (the current one) and I started the process all over again. I was studying at this time, so I had the student status until I started working for the current sponsor. On this one, no. They denied it straight. No RFE’s or NOID. @Abe Moor there’s the reason on a comment above. The reason doesn’t make any sense, specially bc eb3 unskilled doesn’t require experience, plus the form only requires 5 years of job history… Anyways, I should be confident about the outcome, but if they denied me for such a short and incorrect reason, it’s hard to believe that they will fix it… Only I can do is wait…

@Jack jack The only thing I can do, unfortunately, is wait. I’m still waiting an answer about my i290B. And yes, BDV was really fast in answering me, thoughtful all along. They even said that if USCIS deny my motion, they will fight on federal court on my behalf. Envoy also was contacted and filled the motion to reconsider in time. I have no complaint.
