K1 to K3 advice
I filed for the K1 visa on 8/2022. I haven’t received any new information other than my case was received. Hypothetically speaking. I know that if we are now married I would need to change it to the Spouse visa. Based on what I read for form I-130 I cannot use that form if I was not physically present at the ceremony (I.e. if my attorney in Ecuador signed on my behalf)…so what form would I use instead to apply for my spouse? Also do I have to completely start over or can I just submit the form as a addendum and pay the new fee? If I have to start over, how do you advise USCIS to stop the 129F? Is it done online or a letter I have to send? thanks

The United States Citizenship and Immigration Services recognizes and will accept proxy marriage provided the couple consummates the marriage afterward. so you must proof that it actually happened, so like the trip after the wedding and the honeymoon or things like that

The required documents include an affidavit, written statements, photos, and hotel or plane ticket receipts. If you were married by proxy or virtually and met for your honeymoon, you need the receipts and pictures from your time together.

if you are legally married then 129f is not longer a valid application for your case so yes indeed your case will start over
