joint motion to dismis
Good morning everybody
I submitted a joint motion to reopen and to dismiss/terminate removal proceedings Pro se( representing myself) at my local OPLA
last week. I called today and OPLA told me that they agreed and it was sent to the court.
when I called the court, they had no record so they say. and they don't even have the three motion to reopen and dismiss I submitted in January, March and finally May.
I submitted it myself and got their stamp and I served DHS myself with their copy and got my copy stamped also
I called back OPLA and they confirmed again that they agreed to join and filed with the court.
basis: I have an approved I130 at USCIS
question: is there a way to verify if you have an agreed joint motion to dismiss with DHS?

Gaston Gob this is very risky to file by yourself. I would get an attorney.

@joy joy do you have an attorney? usually that's the most recommended way to do it but if for any reasons, you have to do it yourself,
if you have an approved I130, the
preferred way is to ask the DHS lawyer where your case is, so your local OPLA( office of principal legal advisor) to join your motion to reopen and your motion to terminate and dismiss,
you should ask them for their prosecutorial discretion ( if you are not a priority case: criminal case and all) to join your motion to reopen and to terminate the removal proceedings.
in my case the lovely @Steph Romano helped me with example of motion.

is there any way to keep track of a file motion to dismiss? my lawyer said he sent it but not showing any update on the EIOR website. any ideas?
