j1 to green card
hello I’m a j1 visa holder without the two years tule restrictions. that’s what it says in my passport. I’ve been searching and asking how to make an adjustment of status everybody said it’s complicated. can anybody has done this process?? I need it step by step please. I can’t afford paying a lawyer.

You need an employer that sponsors an H1B visa, but before you should check with the Department of State if you need to do the 2 year waiver.

I have the j1 visa and is written at the bottom the bearer is not subject to section 212(E). two year rule does not apply. so, do I have any other restrictions or can I do the adjustment like any other

It is better to check with the Department of State if you need to do the waiver. Trust me, I have known cases that even though it says in their passport they are not subject to the 2 year rule, their AOS got denied because they didn’t do the waiver before applying.

@hector,i have the same visa,2 year rule doesn’t apply,I didn’t check with nobody,everything went through fine.marriage to the us citizen

can you tell me what you did step by step please? what form should I fill because every lawyer I go said that j1 visa adjustment Status is very complicated. and the charging me a lot. I don’t think I need any waiver

@ hector, if the two years rule does not apply to you then you are good to go. I was on J1 visa too, filled my papers by myself by the help of watching YouTube. there’s a lot of people who changed their status from J1 to green card via marriage and posted every step on YouTube

@Hector: If your visa says you’re not subjected to the two year rule, then you’re not required to apply for a waiver. I had to do one because I was subjected. I also got married to a US citizen and I’m adjusting from J1; I’ve been at “ready to be scheduled” since August 2021. You need to file: *I765- work permit allowing you to seek employment (optional) *I485- adjustment of status from J1 to permanent resident *I130- spouse petition for you (they need to file this actually) *i131- emergency travel document if you need to travel before you have your green card in hand (optional) *Affidavit of support-showing that someone(s) is financially responsible for you. The lawyers are correct, it is a lot of work, and it will take time but you can do it. I filed mine and spouse by researching. I started the application, and when I got stuck I would turn to Google.
