@child of God If your I-130 petition (for a family-based green card) has been pending for over **17 months** without any updates, here’s what it could mean and what you can do: ### **Possible Reasons for the Delay:** 1. **Backlog at USCIS** – Some service centers process cases slower than others due to high volume. 2. **Request for Evidence (RFE) Lost or Ignored** – USCIS may have sent an RFE, but it wasn’t received or responded to. 3. **Security or Background Checks** – Additional screening can sometimes delay cases. 4. **Case Stuck in Administrative Processing** – Some cases get delayed without a clear reason. 5. **Error or Misplacement** – Rarely, cases get misplaced or overlooked. ### **What You Should Do:** 1. **Check Processing Times** - Visit the [USCIS Processing Times page](https://egov.uscis.gov/processing-times/), select your form (I-130) and the service center handling your case (found on your receipt notice). - If your case is outside the posted timeframe, you can take further action. 2. **Submit a Case Inquiry** - If the processing time has passed, submit a **"Case Outside Normal Processing Time"** inquiry via: - [USCIS Online](https://egov.uscis.gov/e-Request/Intro.do) - Call USCIS at **1-800-375-5283** (say "Infopass" to reach a live agent). 3. **Contact Your Congressman or Senator** - U.S. lawmakers can submit inquiries to USCIS on your behalf. Find your representative at: - [House.gov](https://www.house.gov/representatives/find-your-representative) - [Senate.gov](https://www.senate.gov/senators/senators-contact.htm) 4. **Submit a Mandamus Lawsuit (Last Resort)** - If USCIS continues to delay without explanation, a federal **Writ of Mandamus** lawsuit can force them to make a decision (consult an immigration attorney). 5. **Check for RFEs or Notices Online** - Log into your [USCIS Online Account](https://myaccount.uscis.gov/) to see if any updates or RFEs were issued but not received by mail. ### **Next Steps:** - If you’re adjusting status (I-485 filed concurrently), check its status separately. - If you’re applying for consular processing, contact the **National Visa Center (NVC)** after I-130 approval.
