is there case denied even tho
was receiving prima facie? I know PF is not guaranteed for approval but anyone you guys know was receiving PF yet got denied?

@tired from waitingg yes, of course. it is very easy to get PF. you just have to send minimum one prove for each VAWA element. I know many cases denied after PF was issued

@blessed & favored you don’t need to prove „beyond reasonable doubt” VAWA, only „preponderance of evidence”, that’s fortunately better for us. Preponderance of evidence means „more likely than not” - that’s more than 50%

@tired from waitingg It means that the party must prove that something is more likely than not, or that there is a greater than 50% chance that their claim is true.

@Mr Turbo yes, but only if you didn’t enter into a marriage while in exclusion, deportation, or removal proceedings. If you did then your prove of burden is by “clear and convincing evidence” so 99%.

okay just to provide a different angle to the information here when I submitted my application I never got a PF instead they sent a letter saying based on preliminary review I did not establish a prima facie case and that I need to provide more evidence. of course I was worried to death as I added everything I could and had no more to offer ( I didn’t respond to the request in hopes that when they are ready to make a decision they will reach out to me again with more specific request: its a risk I took) but I believe when they started detailed review of the application they saw I provided sufficient information and so they approved it w/o asking for more evidence nor the initial one. so I believe prima facie doesn’t predict outcome just tells you if you’ve submitted all the required documents necessary . if they need more information they will ask before making a decision. even if they notice a fraudulent act they will still ask you to explain yourself before they make a decision or maybe not. so it may be possible for an application to be denied even after PF if they find something extremely off.

@PP I so they asked you for more evidence after you submitted I360, and you didn’t answer for RFE, and after 3 years they approved your application? I never heard about something like that. I was working in law office for many years and USCIS denied applications if they didn’t receive response for RFE. you’re lucky man

yes that’s exactly what happened. still feels surreal. but I’m extremely grateful. Again note that I already included what they asked for. so maybe they missed it on that preliminary review and realised it later. again just speculating. no idea what really happened.
