Is it a mistake? approved while not current.
My AOS case just had a status change to “new card is being produced” I was on CRP since February. PD is Aug 2022 which is not current due to the retrogression. I’m ROW. is it a mistake? should i be worried? i waited for it for so long.

Do not allow your lawyer to put you in deep mess! if it turns out to be the GC then you must inform USCIS that you are not current. Maybe they approved your EAD if you don’t have one.

it’s not a mistake. There are scenarios where uscis can approve you if they’ve assigned you a visa number already even if retrogression has taken place.

13 days ago, EB3 Skilled was current for your date. Just check if it was approved in June. If it was approved in June, there’s no problem.

@Matt B that means I have to wait for the notice/card to arrive? because in the USCIS website the status changes only yesterday.

@Mike Mike there is lot of post on reddit and trackit. all of them suggest you have written from usics officer to make sure not encounter problem in future.

@Mike Mike whats your case number starts with? I'm also Aug22 on CRP since Dec 23, and was hoping for exactly what happened to you - that a visa number was already assigned in the past and it'll get approved although not current

If a visa number was allocated to you before the retrogression happened you can get approved. What I don’t know is how we know if a visa was allocated or not, anyone knows? I’ve seen this happening before with other people but not sure how it works.

Congratulations and Enjoy, Grab from both hands and dont look back. Its USCIS responsibility to make sure such matters. You are not at mistake even if you receive your GC during the retrogress period. Congrats again.

@G m oh wow, i thought my case was an exception! did your lawyer mentioned it could be a mistake or anything? my lawyer received the USCIS notices that my wife an I cases were approved but he didn’t say anything else.

@Mike Mike I havent yet received the approval notice via email since I was the one who submitted the RFE response. Ill wait until the notices and card comes and confirm to you. i read that we could be good as we may have had a visa available before the retrogression.

I am also in a similar situation. EB3 ROW, PD of Sept. 2022. Was approved today (July 18, 2024), even though I’m not current anymore. Not sure how to interpret!

@Mike Mike I guess ; it’s uscis responsibility- one way to check if you still have travel history ? if that record is gone then you should be good just my perspective

@G m - You have the same lawyers I do, what did Fragomen tell you? I was told to wait till the approval notice or GC arrived before reaching out to USCIS. Did you end up reaching out to them? What happened in your case? I hope for the best case for you and that it wasn't a USCIS mistake.

@Mike Mike I also have the same issue. my lawyer said that I should report but I still don’t know what I should do. I asked this issue to USCIS live chat. they said I should keep my GC (I already get it). if you don’t report, you might have problem in future my lawyer said.

@airberry sky lawyer suggested going through congressman and ask them to inquire USCIS. I’m still waiting for the response but it is most likely safe to say the GC is valid

hello Guys, I would say I am on the same boat, only that my visa was not current in the last 2 years but I got approved. My PD is 12.05.2022 ROW. According to the last visa bulletin for November my Prriority Date is still not current. despite of that, I got the green card in few days I will receive the package. did anyone of you have an understanding on how to approach USCIS ?
