Interview Scheduled, now what?
I posted here a while back and asked if I should withdraw my N400 and change my i751 to waiver since I was getting a divorce. I drafted up the letter to send to USCIS, and planned to send it this week. Just got the notice that they scheduled my N400 interview… do I just go and hope to have the divorce decree by then?
anybody else been through this?

I have been waiting for my work card under tps for 190 days so I don't know why I have not received approval yet, and uscis denied a first work card for 1 year under I-94, frankly

if you are no longer married and applied for N400, you are not eligible for 3 year rule. try to go with your papers and see what they tell you, Inmigration officers are unpredictable. Good luck!!
Ice CreamMay 21, 2024
immigration officers are very predictable because they follow US immigration laws, specifically INA (The Immigration and Nationality Act). but yeah, what god can't do doesn't exist, it's possible that the law governing us citizenship eligibility is changed by Mel W interview. the chance is very low but not a zero 😁

thank you @Ice Cream @Verah Ans I’m going to consult with an attorney and see the best move forward
Rocco FortéMay 21, 2024
@Mel W You need to send a letter and withdraw that N-400. Then request that your I-751 be converted to a waiver case. Do not just all things so you “see what happens”. If you do that, you might be accused of immigration fraud. Be proactive and do the right thing.

I want to acknowledge that it sucks having to withdraw N400. a few months ago you were probably excited to be finally able to apply. now you are getting a divorce, have to worry about removal of conditions, and have to wait 2 more years to be eligible for citizenship.

@Ice Cream it’s been a ride and I’m grateful to have had the support of my ex when things were great. time to move forward. I only hate that I spent money I didn’t have, I will not involve them any further so withdrawing is best!
@Rocco Forté I can withdraw and submit waiver in the same letter?
Rocco FortéMay 21, 2024
@Mel W Yes you can.

hello can u let us know wat happened after interview. best wishes !
Mel WJul 23, 2024
@sammy glenn @SRC 12/20 I sent the letter to both offices for my i751 and N400 for the withdrawal due to divorce.
I only got a cancellation for the N400 interview so I went to the interview anyway, and they told me both were cancelled. I got a request for evidence letter for the waiver letter for the i751 the morning of the interview to send them the divorce decree.
I have to wait to get it but have till September to submit evidence of the divorce. My status for this i751 still has fingerprints used from 2022 so hoping to get the evidence soon and be done with all this.
