I had my interview Wednesday an the interviewer she was nice calm she’s from the Caribbean haitian Jamaican she’s very nice she told me that she’s going to approve my i130 but because I’m in proceedings of removal the court she told me the judge will have to dismiss the case then I’ll need to come back to her an she will approve my I 485 an I will get a 2 year then after 90 days I can remove the condition. not much question my date of birth she ask my wife her date of birth how we meet etc what’s the relationship I have with her daughter that’s all after I left the interview my I130 start actively reviewing haven’t seen the approval as yet Oakland field office

update: the lady kept my husband for over an hour, then she came out loud like, “can I speak to you?” I went in she have me sworn in then ask how we met, if the date was my ideal date for my wedding then continue to get upset how my husband told her he is a NY resident- my husband still works in NY and travels from NJ he kept his NY drivers license because as you know he used that and his social which he had gotten from his previous marriage some 14 years ago to maintain his job. We also didn’t think that would be an issue. She told me this is not a real marriage because we don’t live together, no matter how I said that we do she wasn’t hearing it. She said to me she is sending his case to NY because he lives there. my husband did not tell her that he lives in NY on top of that, the only lease my husband have is for our current address, every single document he gave her she said that’s nothing. Life insurance, health insurance, lease, joint filing tax return, joint bank account, wedding pictures. We have nothing more to present. Also the computers went down the moment he walked in and has been down even after we left, around 12:30p. We had to get a consultation with a lawyer immediately, who also told us she can’t send his cause to NY because that’s not where he lives, We are now waiting to hear the final decision then take it from there. My husband was so sad and hurt, me too I tried to console him, it’s so depressing.

She never spoke to both of us at the same time today. She scolded him then brought me in to say this isn’t real. I have dated my husband shortly after his first divorce for like four years we split and reconnected in Jan 2021, then got married in Nov. 2023. That’s the love of my life it kills me to see him struggling with this. I’m more hopeful than him though.. He just could understand why the officer was so mean as if she prejudged him before we even started. She was so mean.
