infant of Usc can't give the infant the citizenship
Hello everyone I want to ask my sister is Usc and she give the baby in cairo and the us embassy denied the infant Usc and my sister need to back to USA with in 4 months can she apply for b2 Visa for the infant???? Dear my sister us citizen give the baby at Egypt but the us embassy denied to give the infant citizenship because the mom ( my sister) she's under age(15) now she want to back but she can't back without the baby ( can she apply for the infant for visit visa )???????

Alex - was the child born after your sister became a US citizen or before? if after, then he or she should get naturalised by derivation. your sister, as a US citizen, can sponsor the child. but before that, together they can travel to the US as long as the US embassy issues a visa for the child. once they get here, your sister should start the paperwork immediately as that's still going to be a long process for the child to get an adjustment of status to the the green card, and then the US citizenship after a few years on the US soil as a permanent resident. the embassy should have explained that to your sister, but oh well. but yes, as soon as they arrive to the US, she must start filling because USCIS is going to also look at whether the child was born into or outside of wedlock, which can complicate the case even further and make it even longer.

Mig Mig - though it should be, it's not that simple, unfortunately. there are some factors that come into play that can make the process more complex, and this one might be one as the embassy refused the child the citizenship for now.

Alex - Ok, your sister has a difficult case and she needs an immigration lawyer because she's not even an adult per US laws. her legal guardians need to get a lawyer for her and the child if she wants to leave Egypt with the child. this case also has a lot of ramifications that may require the involvement of lawyers because if Egypt automatically grants citizenship to babies born there or children of Egyptian citizens, and the father is an Egyptian citizen, if he's opposed to the child leaving Egypt, then your sister might not travel with the child even if the US embassy grants a visa to the child. do you see what I'm trying to say? per your explanation, your sister and her legal guardians need legal assistance because she's underage, which complicates her own case with her child and the US. she needs her legal guardians to do the paperwork for the child because she herself is considered a child at 15, and can't do that process on her own until she's at least 18. please, get legal assistance.
