my spouse is a PR (permanent residence holder) and I’m a student currently under F1 visa. he has filled for me, but I’m wondering if I have to maintain my status until my adjustment of status is approved. has anyone been in this situation?

so here is the thing with an F1 status, you already know you have to be in school to mantain your F1 status but my attorney said I could choose not to go to school if I apply to adjust my status but the only risk you are taking is that if your application gets denied then you will have to go back to your home country unless you appear your case and try to fight it. I came to the state with an F1 visa as well and I just dropped out of school though am going back but I only dropped out because I wanted a year off but couldn’t do that with an F1 status. your other option would be to mantain your status while waiting so that even if you get denied you will still remain in the country instead of getting kicked out and try to get back.

Only if your spouse is US citizen, you can choose not to maintain your f1 status.

i agree with @subu tri. As a spouse of an LPR, you being out of status won’t be forgiven.
