Hi, our i-130 was approved and lawyer sent over i-485 to USCIS and already got receipts and Bio appointment.
i have a master hearing May of 2022 and i’m not sure what will happen from now on, will judge terminate court and grant green card or USCIS will grant it and how long will it take??

abii AbiiFeb 12, 2022
tell your lawyer to file for termination in court right now, since you have approved i130 you don’t have to wait till May,
if judge terminate the proceedings, take the termination letter to USCIS,
M AFeb 12, 2022
Will it be fast enough to do that or is it faster to get the green card granted with the judge? because i don’t want to wait two years
abii AbiiFeb 12, 2022
the courts dates are always long, it’s always better to go with USCIS, USCIS does interview under normal circumstances,
but with the court you have to have a lots of proofs of marriage, also you have to bring witnesses at hearing, it’s a long process
abii AbiiFeb 12, 2022
get termination letter from court on behalf of approved i130 ASAP,
I’m sure USCIS will administratively close your i485 since you are in Removal proceedings,
so before they closed i485, give them the termination letter
Sal SalFeb 12, 2022
@MA why are in removal proceedings? from an asylum case?
M AFeb 12, 2022
@judelove No, overstay
abii AbiiFeb 12, 2022
I’m telling you because I’m on the same boat,
but I already got termination letter from the court, now waiting from USCIS for the i485 interview,
Qa yaFeb 12, 2022
@abii Abii are you done from court?
Qa yaFeb 12, 2022
how was it?
M AFeb 12, 2022
@abii Abii i understand, was your file sent to texas? because they take 2 years it seems
abii AbiiFeb 12, 2022
@Qa I didn’t have to go the court, my attorney did speak to the judge on zoom call, got terminated and the court sent the termination letter in 4 days,
abii AbiiFeb 12, 2022
@M A, I’m in California, so my file will be ay local field office where we had our i130 interview
abii AbiiFeb 12, 2022
@QA yes I’m done with the court, last year October 14 I got terminated, now UCSIC have jurisdiction on my i485, my i130 is approved already after interview with USCIS
Qa yaFeb 12, 2022

b bbFeb 12, 2022

t mFeb 12, 2022
@abii Abii did you ever attended a master hearing before you terminate or were you able to terminate with going for MH
abii AbiiFeb 12, 2022
yes I been to 3 master hearings, it only takes about 10 to 15 minutes
abii AbiiFeb 12, 2022
@QA that was a lady judge, she was super nice, she didn’t ask me much, she was only talking to my attorney the whole time, also you have to have a attorney present with you on hearing,
kaya koiFeb 12, 2022
hope you get it terminated soon 🙏
Ren PinFeb 13, 2022
Abii abii, did you terminate your case before filing the i485?
abii AbiiFeb 13, 2022
my i485 is administratively closed, now I got termination letter from the court , I did have interview for i130 with USCIS and got approved
Ren PinFeb 13, 2022
I have a terminated removal case and an approved i130. Now will hopefully have uscis look at my i485 application and adjucate it
abii AbiiFeb 13, 2022
@Rin pIn, what I have hear and read, USCIS will not do the motion to reopen on their own,
brother you have to call them, get an infopass for your local field office where you had your i130 interview,
otherwise it will take very ling

abii AbiiFeb 13, 2022

Huzaifa aftbFeb 13, 2022

don’t make any attempts in closing ur asylum without greencard in ur hand. ur lawyer know that.
Ren PinApr 8, 2022
guys, I don’t have a lot of time to talk much because I have a small baby but I wanted to help here. I also had an administratively closed case and an approved i130. Then my lawyer went to court to reopen my case and terminate it. we filed the green card with the judge along with the petition to terminate my case. the judge terminated my case but referred back to Uscis to process my green card. My case was terminated last June and I got my green card in February. It’s technically the right way to do it but I’ve seen many here who went forward with applying for the green card before heading back to terminate their cases. Best of luck to you all and remember each day is one day closer to ending this journey ✌️

Hey guys, has anyone gotten his removal proceedings terminated in immigration court with a pending 130 and 485 with USCIS?
abii AbiiJul 18, 2022
@ARB B
the immigration judge will not terminate the removal proceedings until the i130 is approved.
Huzaifa aftbJul 18, 2022
@ARB B my lawyer filed for administrative closure even my i-130 is pending then the judge and DHS approved administrative closure then I was able to file i-485

@ARB B the judge won’t be able to terminate your removal proceedings without an I-130 approval.
Arnaud VodounouJul 18, 2022
@Huzaifa Administrative closure and terminate are two different things.
