I’m a green card holder and filling for my spouse who is F1 (3 years now ), should she continue taking class after her I-485 is submitted? we sent the I-30 12 months ago, the lawyer sent l-485 now .

The thing that that the final action date for F2A is Jan 1, 2022! so the minimum waiting time to receive the green card is 3 years unless the dates move forward. My understanding that once you receive your I-485 receipt then you do not have to maintain your status. Most of attorneys recommend that you keep the status if something goes sideways ( denial of I-485), then you can keep your F-1 status because you did not violate it. However, if stop taking class the F-1 status will be terminated. Keep in-mind you can not work anywhere unless you receive EAD. Also, keep in mind if you choose to keep your status, you cannot use your EAD to work off campus or anywhere else, since the moment you use your I-485 EAD then you are no longer in status. I perosnly kept my status since I was finishing up the degree and having pending I-485 did not add much to me back then!

very good input she got approved for her work permit and we are expecting our second child soon soon so taking class will become difficult sooner. and once she start working with the work permit she received , she can’t no be consider as an F1. and currently she’s only taking language classes. not a college or university degree. thank you for your input .
