i751 Evidence
Hi everyone,
I am getting ready to file my i751 petition with my US citizen spouse. I’m in my evidence gathering phase and wanted to ask that for phone bills/ utility bills, do I need to add every single bill since we got married or there’s an advised time period to include? Also we file our taxes as ‘married but filing separately’. Would that mean we don’t have sufficient evidence if we don’t include joint tax statements? Please help, if you’ve already been through this successfully. Thanks in advance!

That will be a big red flag if you don't file taxes together. Do you guys have a joint bank account with day-to-day transactions? You have to prove the marriage again by supporting documents that your marriage was and is real. For the bills send as much as you guys have. However, prioritize bigger bills like property bills, furniture, trips and flights, etc where you spend lots of money. For the small bills joint bank statement is more than enough.

yes we do have joint bank accounts. My wife had some big debts before we got married so she suggested that we file separately at least until she’s able to pay off all those debts. She’ll finish paying them off this year so from next year, we are going to be filling taxes together. We’ve been together for over 8 years and married for 2 this year so we have plenty of other evidence- trips and all

Definitely provide as many Joint documents as you can. Bank account, healthcare, beneficiaries, any type of bills, trips, photo etc. Prepare to answer the question why you are not filing taxes jointly.
