i485 PENDING THROUGH SIJS
Hello!!!
I was so excited when I received the request from immigration that I needed to send my medicals and then they after they confirmed that they received, they marked my case as pending because a visa is not immediately available to me.
At first I thought that it was because FY is almost over so they’re just waiting until Oct 1st to reopen my case.
Then my lawyer told me that it could be because my priority date is no available yet.
For me it is very weird because why would USCIS send me RFE if my priority date is not available?
is anyone going through the same or has seen this before? any thoughts or suggestions?
personally the FY makes more sense but because my lawyer said it’s because of the priority date, so it’s confusing.

Even if your PD isn't current, USCIS can still work on your case. It's the matter of final approval that needs PD to be current.t

@Lisbeth Mendoza because English is the dominant language of international business and global communication, so there is nothing wrong with speaking in English
and also I believe most or all the people in this app wants to live or already live in the US, which English is the most widely used language

It could be that you're next in line and that they are preparing for one a Visa does become available so that it can be assigned quickly to you.

i wasnt current when they sent rfe either. and after that, no decision. you have to wait until you get current

I was shocked that they asked for my medicals too and that gave me hope to get my GC soon but the truth is that you might get denied if your priority date is not current. You lawyer is right, it IS because of the priority date. But do not get discouraged!!! it will be just a matter of time 😊
