I485 denied due to abandonment (Error)
My i 485 was denied last week. The reason is stated in the denial notice that the RFE that was sent to me was not responded to. However, my lawyer and I confirmed that the responses were sent and received by the office. Seems like the only option I have is to file I290B. Any idea how long will that take and are there chances of reverting the decision? Also my priority date is December 2022.

given that that you're still current for filing, but not for FAD, is there anything which keeps yourl from just filing a fresh application immediately, with whatever was requested for in the RFE. To should already have copies and documents together so it should be an easy lift and shift

also, out of interest, what was your RFE if you don't mind me asking. I believe you would have only been able to file on Oct 1st, and that usually RFEs give you 90 days to respond. So I'm really wondering what they could have wanted so soon

@Gnu Wu RFE was for approval notice for I-140 since I-485 was filed concurrently with I-140. They asked for the approved letter.

@Angie P Would definitely look into this further with my lawyer, thank you! Also, I know friends whose case went to “Pending” and says Visa number is not available so processing has been paused. Since mine was denied, I guess they did not have to wait to send the denial letter.

@Angie P please note USCIS has the authority to look at your case even when it's not current.They can send you a request for evidence, ask for medicals even conducted an interview they just shouldn't approve your case. Some officers periodically review I-485 to ensure the file is ready the be approved once visa number becomes available.
