do you know if he had felony or misdemeanor charges and if you know if there’s any injury or property damage also if you know what was filling date and which state

DUI appears to be the red flag and a very likely reason of denial unless there’s more to the applicants history. the applicant can appeal but in the time being he or she must prove by doing courses or rehab and get more letters for good moral character.

only one dui without injury or property damage 3 years ago shouldn’t be problem but if there’s mor criminal background can be really serious

@green card @Mein Gandu only one dui, no other criminal history, no property damages, no accident, no one was hurt. Filing date was from 2020. He did all the course, aa, probation and some test to get his license back in 2024. He lives in massachusetts but was adjudicate in Florida, dnt know why based on previous emails forwarded to him from his lawyer that the senator sent. It showed his i485 was at a Florida location.

@alhamdullah Alhamdullah I would have to ask him if its a felony or if the case was dismissed. I know he got 1 year probation, had to do couple hrs of AA and did some test to get back his license. It happened in Massachusetts.

@alhamdullah Alhamdullah @green card, incomplete evidence that was submitted back in 2023. the disposition of the dui, the probation was not complete so they said insufficient evidence. His probation was completed in July of 2024 so it was imposed for the lawyer to send that in 2023. So I am hoping if the lawyer refiles or reopens the case he will get through. He definitely learned from his mistake and am hoping he gets a second chance.

@Love ❤️ so the denial notice was saying because insufficient evidence? if so it’s way better and that’s good sign that means USCIS did not have enough evidence to prove the I-485.

@Love ❤️ trust me I’m gonna be clear with you yesterday I had a individual hearing by the IJ for my I-485 and I had one of the most strict judges on the immigration court and I also had an old criminal record which it was solved and dismissed 9 years ago and yesterday I got approved on the spot and it went so smoothly. so tell him do not worry it will go through. and I’ll share my experience soon once I go to my next hearing which is the formal approval, it was supposed to be posted on the website yesterday but because of my BCR was not completed and the court did not get it, we did move in 2 weeks and the judge said if that’s all u have then you are granted. good luck. so trust me just patience and time.
