I485 denial based in I130 denial
I got my I130 denied, in the denial notice it said that I wasn’t legally present in the US when I filed my case. Which doesn’t make any sense because I submitted I94 with my application indicating that I was legally premitted with my F1 visa, which is still valid until now.
any advice?

@Mo Salama file a motion to reopen with proof that you were still in legal status when adjusting your status based on Marriage. if you prove them that they were wrong, you will get your case approved since with your F1 status, you still legal. Good luck.

@Hmmm Hmmmmm motion to reopen is not an appeal... I know appealing takes FOREVER and sometimes it would be the same answer. but with the motion to reopen, he can respond and sent proofs.

@Mo Salama file a Motion. same happened to me with the same denial notice. I filled a motion before the 30 days and my case was reopen in 10 days, just waiting for a new decision 🙏🏽

@M B I have a question if you please. did you file a motion for both I485 and I130 or just I485?
