I485
Anyone with experience of NIW: primary in US and dependent in abroad, and i140 approved status? Right now, primary can't go abroad and dependent don't come US as they don't have visa. I am confused on i485 processing and success of it after handling it in different locations?

it is plausible. As long as primary is in status, they can submit an AOS I w form I-485 and then a follow to join cas for the dependent outside the US

@Yeshiye Fibo I am in a similar situation. My attorney informed me that because my daughter was listed on my I-140 and I-485 but is not applying with me, USCIS should notify the NVC automatically so she can apply for her green card at the embassy in London. If they do not then I will need to file I-824 for follow to join benefits

That's great folks. How about you idea on my plan to submit i140 with Chen (law group) and i485 without any lawyer? Mainly because I assuming i485 will not be challenging after i140 approved and i485 attorney and filing fee come very costly. @ and @Josh B what is your experience on hiring attorney?

@Yeshiye Fibo I had a great experience with Merrill Cohen. I felt she was very honest about the strengths and weaknesses of my case, and helped me strengthen my profiessional profile. When I reviewed the case prior to submission, I was impressed at how easy to follow and clear the case was presented. I remember thinking to myself that if I run into issues such as RFE/denial etc. then it wasn’t because of how the case was presented. I was lucky that I got an approval without RFE in just a week! I think you can file your I-485 yourself. I just had my attorney do it for peace of mind and to submit everything at once including the I-693 medical

file i824 now. that's what I did. I got approval for i140 in 2022. I filed i824 for my spouse abroad. reason is i824 takes a long time. you will most certainly get a RFE to hold i824 in abeyance until i485 is approved. my i485 was approved march 28th and my i824 was approved 25th April. now I am waiting for NVC welcome letter for spouse. don't wait do it now
