@Don Kdj , Make sure you have solid proof of any abuse in the relationship. My advice is that try and engage your partner in meaningful dialogue to mend fences.

you will need solid proof of the abuse and show a pattern of abuse. texts testimony police report if you have any and psych eval if needed to prove physiological/mental abuse.good luck

My husband submitted my petition after much begging. The day before, I sent a VAWA with all the evidence. Here I am, waiting for my EAD and SSN. And an interview to clarify the situation. I have already completed biometric data for both cases and my prima facie for VAWA has arrived.

@Don Kdj, Make sure you keep them beyond his/her reach. But please secure the services of a lawyer. Such cases are complicated.

it sounds like you may have a case not sure about the cheating part but with physical abuse need pictures/testimonies/ hospital visits etc

you just have to be able to prove to cycle of abuse per say

vawa is 3 years+ for approval for if you can do it through i130 it would be faster. lots of things to consider.

no police report needed but it helps prove the abuser. as long as your evidence is clear and you have a good affidavit to explain the abuse in the marriage.

yeah anything that proves abuse. it just can't be like a one time scenario or fight. it's faster approval for 130 then 485 then it is for vawa. vawa you can wait for 3 or more years for approval and what I have seen 130 is approved way faster. that's where you have to do some homework. I would recommend looking for a free consultation with an immigration aty and then if they advise vawa is best you can do all yourself if you cannot afford a lawyer

@Don Kdj I would advise you start stacking up evidence.. proof of a real marriage, proof of abuse, save all text messages where good or bad that was texted.. save pictures, if you have a police report. lease and bank accounts with both yall names on it. get those that knows of the abuse ask them to write letters.. and get them notorized.

@Sanchez . VAWA is the best option. An abuser can cancel your petition when they want to control you, and it's unsafe to live in that situation.

@Don Kdj please fact check me, but I'm almost sure you can switch to vawa so long as the petition has not been withdrawn and have the same priority date. Best case, since there is already a case in progress, if us citizen, then fake what you have to and get that green card. Still stack the evidence because if you get divorced or separated after the conditional green card, you'll still have to prove it was a good faith marriage that fell apart and not marriage fraud to get the 10 year green card 2 years later. But consult a lawyer and switch to vawa...I wish I had done that before he withdrew my application and I had to start over and it's now 4 years later and still waiting.
