i have a important question!!!
i wanted to know if theirs a waiver that my husban can apply for so he dosent have to leave the country and finish his 1485 here in united states??? or is it really mandatory that he has to leave the country and come back legally to united states?? i have very bad anxiety from him even leaving for 2 hours and im scared if they decide to keep him in mexico he is my support and he is the one working and supporting us and his 4 children will they really have to send him...

if he entered undocumented he needs to do the i601a which he could get approved while he is in the US but either way he has to go back to his country for a few weeks for the medical exam and his interview. as long as he is completely honest in the application and interview and has no criminal record or muktiple entries he should be approved. The i601a waivers from what I see now are taking about 2 years. i am using Attorney Lizz Cannon.. i heard she is one of the best for waivers and my fiance insisted on using her. we want to errors. he is in his country now. he went back 6 years ago after a visa overstay.

thank you everyone appreciate the response and i just spoke with my lawyer and she said the same as you @jessica amador she says i dont have to worry because he dosent have a criminal record nor entered many times his mother brought him at 3 years old and has never left and luckily she has every doctor record since age 3 1/2 and up and he graduated from school so lawyer says he has nothing to worry if he goes that most likely it will be 1 month stay she did mention that sometime it can be 1 week or 3 days depends how fast they are she said

does he have Daca? i have heard of a lot of Daca people applying for Advance parole... its a slight risk but I have seen it accomplished. they go to their country and re-enter legally. he can now adjust status and aboid the i601a

due to covid they are suggesting going to the medical 2 weeks before the interview but that could all change by the time he has an approved i601a. usually the medical is about 1 week before.... then it takes about a week after to get the visa. most cases I read about they are gone 3 weeks if everything goes smoothly
