fuki keke - If your category qualifies for the 180-day extension and you received one, then yes, you can work with it as it is extended for another 180 days from the date of expiration of the current one. π

Hi Fuki, I'm not 100% sure about L2, but I have a L1 and I was able to continue working after I-94 expiration with a pending extension application. The rule is: as long as you submit the visa extension request before I-94 expiration you get 180 after expiration date as a grace period with work authorization. After 180 days if you don't get a response for the visa extension (which could happen with the current processing times), and you don't have an EAD then you have to stop working. In this situation your company could put you under "leave of absence" though and maintain employment relationship without payment until you get work authorization is my understanding.

I filed for a renewal in Nov 21 along with my spouse who is eligible for premium processing so his L1B was approved in 14days , but mine is still pending L2 and EAD renewal

fuki keke - ok. have you received an I-797 extension from USCIS while your EAD renewal is pending?

ok, fuki keke, then you can continue to work. just show that I-797 to your employer. they'll make a copy to add to your file with them, and that's about it. π

you canβt work with an unexpired i94. but if you have a valid i94 and applied for EAD renewal before itβs expiration, the automatic 180 days applies and ends either after 180 days or i94 expiration, whichever comes first.
