hello, first off happy new year to everyone and I do hope this year is your year for nothing but happiness and good fortune. with that said can anyone advise me if it’s ok to go ahead and apply for my work permit under the c9 category while I wait on my pending vawa without applying for I 485, or is it recommended to do both. I’ve applied in August 2022 and I have received multiple prime facie.

@sweet Lins ok thanks, will the fees also be waived once approved and its time to file form I485 or I’ll have to pay?

@Queen Bless First of you can not file work authorization alone without filing for I-485 adjustment of status because your work authorization stands on your adjustment of status application. Now if your ex spouse is a permanent resident you cannot file I-485 adjustment of status. you have to wait for your Vawa approval before you can adjust your status by filing I-485 and work authorization. However if you were married to a US citizen you can file for your adjustment and work authorization c09 any time and it’s advisable to file it now so you won’t have a long wait after your Vawa is approved.

@Queen Bless … what everyone suggested is correct. they are totally right. please proceed to file your I-765 under C9 so that you can work and keep yourself together pending when they approve your case okay. if you are waiting on C31 then be prepared to wait 3 years which is normal processing time. so please go do the needful right away without delay okay.
