I-751 to N400 Question
Hi,
I have a pending I-751 and I’ll be eligible to apply for N-400 in Dec 2024 per the 3 year rule. My sponsoring spouse will be 2.5 years as a US Citizen by this time but I read the sponsoring citizen spouse should be a citizen for at least 3 years or more for me to qualify under the 3 year N400 rule
Since N400 processing takes around 6 months at the least by which my spouse will be a citizen for 3 years, can I apply in Dec’24 or wait until May-June 2025?

The 3 years rule apply to you, the US citizen petitioner. you are eligible to apply N-400, in 2 years and 9 months after the date your I-485 got approved.

you can check your elegibility on USCIS website. you are not elegible if you spouse became a sitizen less than 3 years ago. they will just deny your case right away

@Sherlock Holmes, you should wait until your spouse has had a full 3 years of citizenship before applying for N-400, as a matter of fact, if you file online and it asks you the eligibility questions, it should tell you, you are not yet eligible.
