I-751
Hello All, If I am married to a US Citizen, do I need to submit bio metric fee with my form I-751? I had a biometric about 2yrs ago when I got the conditional green card.
The I-751 instructions document statement is confusing. it states under Biometric service fee Item 2 that
“if you are the US citizen or lawful permanent resident spouse, you do not need to include biometric services fees at the time this petition is submitted. if USCIS later notifies you that you must submit your biometric, you will receive a biometric services appointment notice with instructions on how to submit the additional fee”
Do I still need to submit bio metrics fees based on the statement above? I don’t want to waste money

that is for your spouse not for you. you have to pay the biometric fee even if they reuse your biometrics.

I’d do it just to be on the safe side

@R H I chatted with an agent via emma and she said I don’t have to include a biometric fee at this time. or maybe she misunderstood me. however, why would a US citizen spouse need to do biometric? When I read that statement, it’s didn’t sound to me like they were referring to my spouse since my spouse is not the one filling. I guess I will include it to be save but we all know they will reuse the biometric I gave 2years ago

@toss fem they will most likely reuse the one from 2 years ago. but whoever the petitioner is, they still have to pay biometric fees even if they reuse the old one. you are the petitioner, so yes, you have to include biometric fees or they will reject your petition. I hope it’s clear

That’s what I said that your spouse is not required to do biometrics but you will and you have to send that fee.
