I-751 RFE
I have submitted my I-751 form jointly on September 2021 and got divorced in May of 2022. My lawyer sent an amended I-751 form on October 2022 and it seems that USCIS never received the documents and I received an RFE from them in April 2023 requesting additional evidence. Should I submit a letter explaining the reason for my divorce ? my ex-husband wrote an affidavit for me. also what type of evidence can I submit? I have heard that since my case will be converted to waiver, it my take more time (years) to hear back from USCIS. is it true ?

@Blessings D How do you know your case has been amended when they never received the documents you sent?

does anyone know if the tax filing for removal of contiton has to be three years and 125 percent above poverty line like when one is applying for conditional green card? or it could be any amount and one year is enough? just asking out of curiosity. would appreciate your answers. thank you

@oliver WP There is no poverty guidelines required for I-751. I-751 is just the removal of the conditions on your greencard. Essentially, you are just sending in evidence to prove that your marriage was entered in good faith and you continued to stay married to your spouse

@Rocco Forté my cass has not been amended yet. USCIS sent me an RFE and I will let them know when responding that I am no longer married

@Blessings D if you have your final divorce decree with you then it is very easy and straightforward process. Write down a brief statement about your marriage and how it ended. Mention all the major events that led to divorce. ask friends and family who are well aware of your marriage and divorce as well. If you guys went to marriage counseling then also add those documents or mention the counselor name and address as well. Collect all the new documents that you never shared with USCIS while filing for I 751. If it is possible ask your ex in-laws or your ex wife to write a statement about marriage and divorce. I hope these things will help you.
