You’re not eligible to apply for citizenship. You should be praying to first of all get the 10 years GC and after that, you will have to complete the time duration that attached to the category under which you got the GC. I guess it’s marriage based so you have to wait for 3 years after getting the GC

When I talked to my lawyer she said that I will be elegible to apply on January 12 of this year, since I will have 3 years with My GC, she said that they usually do like a combine interview, but I’m not sure.

@victory spouses of US citizens can apply for citizenship after three years of being greencard holders. Maria is eligible to apply for citizenship and she can apply three months early.

@Maria if you want to get your case decided quickly, file N-400 but make sure your marriage is still strong because you have to re-prove it

@Rocco, did you read what she posted? she’s still a conditional GC holder and the condition has been removed and she doesn’t have a 10yrs GC so how can she now apply for citizenship?

she definitely can apply. no matter if she hasn’t received the 10y green card yet. After being married for three years to an US citizen, starting the N400 process is totally fine. And as Rocco stated, the application can even be sent 3 months before those 3 years. In some cases the I751 process is actually dismissed as the naturalization request gets accepted/approved earlier.

@Victory, When one is married to a US Citizen, the time in which you spend as a conditional resident *counts* towards the 3-year minimum (2 years and 9 months if you wish to send it the earliest possible and acceptable by USCIS). One does not have to wait 3 years AFTER getting the 10-year conditional green card if the person is still married to the US Citizen and decides to apply for citizenship while still waiting for the I-751. You do NOT need to have the I-751 approved first before you decide to send in the N-400. People do like to have their I-751 decided on first because for most, depending on their cases, they don’t have to head to an interview if their evidence is strong enough and if they were already interviewed by USCIS. This avoids the hassle of having to prove your case again to an immigration official. However, there are cases that take forever and it has been proven that starting the N-400 while still waiting for a decision on the I-751 does make the process move forward/faster; however, this means that you will most definitely be interviewed for the I-751 first and then the N-400 interview, most likely on the same day. Lots of people would love to avoid having to prove their cases again to USCIS, but if that’s what it takes to have the case actively reviewed, most applicants do opt to send in the N-400 while the I-751 is still pending. There is nothing wrong with that and if you are able to send it, then by all means do so. It will advance your case. The only caveat is that you will most definitely get interviewed again, but both cases are decided on simultaneously and on the same day. If your marriage is real and the evidence is strong enough, there is nothing to worry about :). If you are willing to embark on showing USCIS once again that your marriage is bona fide, then by all means it’s highly recommended to send in the N-400 as soon as you are eligible to do so while the I-751 is still pending and hasn’t been decided on.

@Maria I have seen 2 people get approved but they filed Dec 28th 2020 and another was Dec 15 2020 I believe. One petition was approved 355 days after filing and another exactly 365 days after in Vermont. Both sent in good evidence and still with their partners. I think in the best case scenario you are 2-3 weeks from being approved but it won’t hurt to do ur N-400. Good luck!

@emily smith what if your I-751 is ready to be scheduled for interview and you didn’t get the interview date untill you are due to apply for citizenship, I heard they cancel interview sometimes and ask for more evidence or approved the case.
