i-751 , case approved
hi guys,
my i751 , removal of conditions was approved and I got my 10 year GC on 13t July. its been 4and half years now. now my question is -
* can I apply for citizenship i400??
* if I do apply , do I ahve to provide all marital records again?
* and does the citizenship interview consist of questions regarding legitimacy of marriage which I had gone thorugh during my interview for I 751.
* are the interviews as hard as I 751 interview?
thank you!! I would like your opinion on this.

did you get any Request for evidence?
the_girl .Jul 15, 2021
I think you have to held the gc for a number of years before applying i400,

I did not get rfe. they called for interview for I 751..I passed and got 10 year GC. so the overall years I spent in US is 4 and half years. I heard the rule is if you ahev lived for 3 years in marriage , you can apply for natuilization

When was your 2 years Greencard approved?
the_girl .Jul 15, 2021
I didn't know if you already lived here for a number of year you can directly apply for naturalization, that's perfect then thanks for the info
Rocco FortéJul 15, 2021
He can only count the years from when his conditional greencard was approved. For instance, if he moved here in 2018 but his conditional greencard was approved in 2019 then he will be eligible to apply for citizenship in 2022 if he is still married to his wife and 2024 if he is no longer married to his wife

I I my conditional green card the moment I entered the country on 2017. now after removal of conditional gc, I got permenant gc , so it's been total 4 years.
now my main question is do I have to submit all marriage doc and proof again for citizenship application .. and will my citizenship interview be as scrutinize as my i751 interview
Aa JJJul 15, 2021
you are eligible since you are still married and completed 3 yrs.. i don't think so you need to submit proofs for bona-fide marriage for citizenship.. Go on uscis website and see n400 requirement.. you should be fine...
Vanessa MartinezJul 15, 2021
it will be better to read the instructions so you know what documents exactly you will need to submit. if you’re married to a US citizen then you’ll be able to apply within 3 years with green card

when did u file your I751 ?? can u tell timeline with months ?
Eko LawJul 15, 2021
If you're still in marriage you need to be on green card for 3 yrs. But if not, its 5 yrs. But if u are in marriage make sure the marriage is in good shape bcos citizenship base on 3 yrs marriage will be approved only if u can prove you're still with ur wife. Note the onus of proof lies on u, not uscis. Therefore, weigh ur options to see where u stand. For 5 yrs, u need not prove u are with ur wife. I have a similar experience.

April 2019.. it took 2 years and few months to ve called for interview.. I think it got delayed due ot pandemic
sonam choJul 19, 2021
but will the citizenship interview be as strict as the i751 interview I had to proof my marriage??
Rocco FortéJul 19, 2021
that’s a tough question because it really depends on the merits of your case. if you file with strong marital evidence and show up with your wife, I don’t expect it to be hard
sparta worlJul 19, 2021
I submit for my I-751 now I got a letter requesting for more evidence
sparta worlJul 19, 2021
it’s stressful
Rocco FortéJul 19, 2021
What extra evidence did they ask for?
sparta worlJul 19, 2021
taxes, W2 etc
Rocco FortéJul 19, 2021
You didn’t send your taxes with the initial package?
sparta worlJul 20, 2021
I did
Rocco FortéJul 20, 2021
That’s weird asking for what you already given them
sparta worlJul 20, 2021
I didn’t send any W2 I did everything myself now I have to get a lawyer
Rocco FortéJul 20, 2021
Why do you need a lawyer if you are just sending them your Taxes
sparta worlJul 20, 2021
I don’t want to make any mistakes Bcz you only get RFE once
Rocco FortéJul 20, 2021
Yea I hear you. I think you if they are specific about what they asked for just send them and not go spend money on a lawyer. if they were not specific then get a lawyer
sparta worlJul 20, 2021
yea that’s why I’m getting one
Rocco FortéJul 20, 2021
Cool
Eko LawJul 20, 2021
Spartans worl.. what tax document sent initially? tax transcript or tax return form?
sparta worlJul 20, 2021
tax return transcripts
Rocco FortéJul 20, 2021
You sent the very thing they like and they are giving you RFE. These people look for every possible way to delay your case
Eko LawJul 20, 2021
well, may be it's misplaced. Don't worry send another one.
Eko LawJul 20, 2021
Spartans worl... let ask once again, ur tax transcript u sent is the one u downloaded from irs or sent to u by irs? or one printed after u filed ur tax?
sparta worlJul 20, 2021
exactly and I’m so pissed, I’m been married for 4 years, living together stillness , we have same bank and credit accounts, we file our taxes marriage filing separately Bcz it works out better for us, submitted over 20 pics, joint lease agreements, our bank account in the beginning of our marriage was close Bcz we were having marital issues but we managed to work it out and reopened a joint account, now they’re saying our banks doesn’t show enough transactions throughout our marriage it’s ridiculous
sparta worlJul 20, 2021
@ Eko Law I printed it off the website
Eko LawJul 20, 2021
Don't pissed up. pissing up we further blur ur thinking. They have suspicion something is not right and it's ur duty to prove it. Just be calm I know it's frustrating.
Eko LawJul 20, 2021
Sparta worl... pls be specific. is ur tax transcript downloaded from ur irs account or irs post it to u. Your response 'I printed it off the website' is not specific. I need the information to be able to guide u so that u don't make mistake I made. there is tax transcript and there is tax return form, and sometimes tax return form was mistaken for tax transcript which is reason my case was denied.
sparta worlJul 21, 2021
I printed the tax return transcripts
Eko LawJul 22, 2021
sparta worl. ... 'I printed it off the website' and 'I printed the tax return transcript', from where? IRS website? Yes or No, to make it simple for me to understand ur answer.
