I-485 timeline after RRFE
Hello all,
I submitted my I-485 on Jan 09,2024 to Dallas, TX lockbox: National benefits center
PD: Jan 10,2023 EB2-NIW
I received RFE on birth certificate and I replied on March 09,2024. I don’t have any updates since then. based on my zip code my local FO is Charleston,SC.
BTW I already got I-765 approved on Feb 2024, but no updates on I-131 and I-485.
I have seen few approvals with Jan 2023 PDs. Anybody with similar timeline ? Thanks in advance!

@No image, Congrats 👏 for your approved i765. If you need it for you, it definitely is something to rejoice about - otherwise, it's isn't a big deal.
About when you can get your i485 approved, that would be just a guess as all applications don't follow the same trend. The earliest I have seen is ~60 days from i485 submission while the farthest is beyond 1yr+. So, pray and be optimistic.
Just to learn from your profile, as your i765 was pretty fast, when did you do your biometrics? How long after biometrics did your application update to finger prints received? How long after that update was your i765 approved? Thanks!

@Rijo Rijo Thank you! My fingerprint was received on Jan 12, 2024 after 4 days of application received. They reused my previous biometrics. my i765 was approved in 45 days from the received date.

@No image, thanks a lot. This is helpful. And fingers crossed, you hear from them shortly!

@Rijo Rijo Thanks

@No image how soon after your I-765 was approved, did you receive your card in the mail?

@Em I think after 2 weeks, they provide tracking number as well.

@No image Similar timeline to you, I-485 received at Dallas LB on January 4th 2024, my priority date is January 6th 2023.
Received RFE for birth certificate on March 20th 2024, response to RFE was received at National Benefits Center on March 29th 2024. Since then no further update to my case. Also no response to I-765 EAD or I-131 AP.
It’s anyone’s guess now, no clue or indication when things will move for me.

@Mr BD, interesting scenario when compared to that of @No image. Just wondering why they didn't issue an EAD yet. Maybe a direct i485 is what they are targeting? Do you have kids? Am asking as @No image's kids got EAD approval prior to their i485 approval.
And could you share what the birth certificate RFE was about? My birth certificate had just first and last name while I use a middle name issued during Baptism in my official name. Is appears in my official documents but not on the birth certificate. I bet this is one of the reasons for birth certificate RFE right?
Mr BDJun 19, 2024
@Rijo Rijo No kids, just a spouse.
The RFE for birth certificate was not specific about what was wrong with it. Both me and my spouse got the same RFE. It just said they required our birth certificates despite them being included with the I-485 application. So were they lost, not scanned into their system correctly. Hard to know as it was not specific.
Our RFE response was a covering letter enclosing the same birth certificates again. We also included a print out from the Department of State reciprocy agreement showing that our birth certificates comply with the document rules for acceptance.

@Mr BD @Rijo Rijo No kids just spouse. yeah birth certificate rfe was same for both of us (me and my spouse). I was surprised to see RFE because we submitted all documents at the beginning. My lawyer told me that sometime they just issue RFE without significant reason. I hope he is correct lol
Mr BDJun 19, 2024
@No image Our lawyer said the same. Seems unfair given we both sent what was required in our initial I-485 applications! Best of luck, hope you hear soon.

@Mr BD Thanks. BTW which is your FO?
Mr BDJun 20, 2024
@No image My case is at the National Benefits Center. So far it’s not passed to a local FO.
No imageJun 20, 2024
@Mr BD Same for me, but I believe they assign to the closest FO based on your zipcode and case might get approved without saying it has been transferred.
Mr BDJun 20, 2024
@No image Interesting, I didn’t know that they do that.
