i-485 stuck since August 2020
adjustment of status applicant via employment. filed may 2020. had biometrics in August 2020 and have had no update to status since then. got EAD combo card but extension expires in 4 weeks and this is also been filed and pending since June 2021. have emailed congressman and no response from USCIS. have inquired since the case is outside normal processing time and no response as well. any filers around that time frame stuck as well or successful and mind sharing what worked for you?

I am in same boat Niko, PD for EB 485 February 4th, EAD expired and currently on admin leave. I140 approved Sept 2020.

is your I-140 premium processing? has it been approved? maybe because of that too.

i140 is approved. i filed for a EAD renewal in June 2021 it is still pending. i submitted an outside processing time request and all USCIS have said is they have received their request and they aim to respond within 30 days

my company lawyers opine i should have it by end of January but i don't feel as confident as they do from what I am seeing

I got one stating I would have a decision or notice of action within 60 days - that was 2nd of December.

ok, I-140 approved is great news. when was that approved? I suspect it wasn’t approved more than one year ago, which means USCIS thinks your case is still “fine”. many of us are in the same situation

no not been able to talk to tier 2 all they say is your service request has been assigned to an officer and they will respond once they get to it within hopefully 30 days.

Yes, I got to speak to a Tier 2 to request an expedite of my EAD (still outstanding, I expect to be rejected!) - I submitted a service request for my 485 being outside normal processing and got a response saying it was with an officer, needed extra review and I will get action in 60 days or a decision.

I got a response about 2 weeks after service request and a note saying 60 days for a response - whether I do or not is another matter! EAD is currently 11.5 months since PD.

no my case just fell outside processing time so before I could not they would just tell me I'm withing normal processing time so nothing that could be done

I called the number and then to get to a live person say reschedule biometrics appointment, and, when when asked if the appointment has past, say no and it will connect you to the agent.

@niko b: sorry for asking so many questions, it feel like you and CG 7 and me should get our own whatsapp channel :). so I get it now, your attempts to push your case were not successful as USCIS kept saying you’re in the normal processing time, and only 10 days ago your case went out of the normal processing time (I believe it’s 8th of June 2020 now, and your receipt date is 25 May 2020). it makes sense now. please keep us updated, my date is August 3rd so I’ll just add 2 months to the date when you get your GC :))

yes it's stressful because it just fell out of normal processing time as you say and i contacted them 15 days ago for the request. but my EAD is already in the extension period with only 4 weeks left to work and the EAD will take a few months more still to approve and expedite requests are being denied. i do not want to lose my ability to work

so Niko on EAD: you filed I-765 in June 2021 to renew EAD, and it expires at the end of this month. is that including the 180 day of automatic extension? if yes, it means the submission in June was probably sent late

extension expir3s en feb. you can only file 6 months prior to expiration but it takes now 11 to 13 months to process

I submitted EAD renewal in Feb, my EAD expired in May - so four months before expiry. I am now 11.5 months in - just wish I could get that and I would just forget about GC.

I am in the same boat, 485 submitted on Aug 2020 and 140 approved Feb 2021, no medical RFE, transfered to NSC a year ago, could expedite second EAD and got it in January 2022

@A S: Zara’s I-485 is not yet out of processing time. I know that as I submitted mine on 3rd of August and the date on USCIS site indicates 9th of June as the date for an inquiry. So still one month and a half until we can call USCIS on this

@mihai sure, i could raise 3 or 4 SR , the system allowed me but no one replied just once said wait for 60 days and you will be updated however no update after 60 days after that raised two SR and no reply, transfer cases to Nebraska seems ghosted

Unfortunately, EAD expedite from January 5th was denied this morning ‘due to the high volume of requests for this type, strictly enforcing the criteria’ - I give up with these, I’ll just need to wait now.

i submitted another EAD expedite request, finally got the email today to provide more info. they usually get back within 24 to 48hrs of sending info so will update the group with results

funny how that is they can read multiple pages of support documentation within two hours. but an outside normal processing time request where you are just asking "hey what's up" that takes weeks and weeks

if I’d be USCIS I would hire more people and have premium processing for all document types. This way people will solve their situation and USCIS will address the funding challenges
