If your priority date is current under the chart USCIS designates for that month, USCIS allows employment-based applicants to file Form I-485 while the Form I-140 is pending or after it is approved, and a pending-I-485 applicant can also file Form I-765. For April 2026, USCIS said employment-based applicants had to use the Final Action Dates chart, and the April 2026 Visa Bulletin shows EB-2 as current for all chargeability areas except China and India. So if you are chargeable to Venezuela and otherwise eligible, the rule itself does not require you to wait for I-140 approval before filing the I-485 and I-765. What I would not promise is a fast EAD timeline. USCIS’s current screening-and-vetting regime has affected some pending benefit requests, so recent timelines are less predictable than they used to be.
