I-485 got approved after denial
I am posting here the story so people with the similar situations get some idea. I got my green card approved on June 2022. I got married before my green card got approved. In October 2023, I applied I-485 for my wife. In February, she got her EAD card. She accepted her graduate school admission based on the EAD card. Surprisingly, a few days later we got her I-485 denial notice mentioning that she didn’t submit any i-140. However, we actually did submit my approved i-140. More on that, the denial letter mentioned they sent us RFE and we responded, but our response was bot satisfactory. Interestingly, neither me nor our lawyer received any RFE. So sending responses was out of question. We immediately applied for I-290B, motion to reopen. We reached out to USCIS severap times requesting to expedite the process as my wife needs to confirm her admission in graduate school. But USCIS refused to expedite. Then our lawyer raised an ombudsman’s office inquiry. After one moth, they reached out to us and mentioned they communicated with USCIS to look at the issue. On May 08, USCIS reopened the case and approved our I-485 in the same day. Our lawyer from the Chen Immigration was very proactive and made our life easier. We are grateful to him. what’s their official name called? I think I need to fire my attorney. completely lacks empathy and has so far told me to just “wait”. worst mistake ever to hire him.

@Opu Islam congrats, recently my case denied as not submitted addtitional evidence within a time frame. i did not rec'd RFE at all from USCIS. after two weeks started chat with Emma and they send denied notice. without RFE how case rejected? rais same complaint to ombudsman's and waiting response.
either denied notice wrong or case officer.

@I N the law firm that I worked with called Chen Immigration https://www.wegreened.com/. I worked with an attorney named Flores
@adc def seems like they do sometimes. But if it is an error, I think ombudsman’s office is our best option. But keep following with them.
@Dr B Thanks. Actually she got an assistantship along with her admission, which is a paid position. so to accept that she needs a valid work authorization.

@adc def seems like they do sometimes. In the case of error Ombudsman’s office is the best option. But keep following with them. It took us 2months to get a reply from them
