i-485 form with F2A (B1/B2 Visa) / i-130 already approved.
Hi everyone !
I would like to know if one of you guys, can help me or give me an advice with my case.
Recently i got my i-130 petition approved, and my case is currently at the NVC, i’m at the stage where i just submitted the Affidavit of Support and civil docs.
In my country, there is a huge backlog (2 years backlog) to make you an appoiment for an interview at the embassy.
i would like to know, if one of you had or heard about AOS with a F2A having B1/B2 Visa (6 month maintaining legal status), while having the i-130 petition approved.
it is possible???

hi. filed for aos and i have an approved i-130. my case is already in the embassy. huge backlogged made us do aos. my husband is LPR and i recently got combo card. we filed with a lawyer though because we wanted a legal representation for peace of
mind. goodluck!

Only immediate relatives of US citizens can have their overstay forgiven. There is no guarantee that your AOS will be approved before you go out of status. Only way this will work is if your spouse will become a US anytime soon

tigerlilee, are you saying that you filed at a consular office, then switched to AOS because of a backlog in your country's consular office?
