I-485 AOS dismissed removal proceedings
I-485 - Removal proceedings: - Married on January 2, 2020. - Court appearance on January 9, 2020. - Case dismissed on June 23, 2023. - I-485 filed in February 2020. - I-130 approved in February 2021. - The last update on my I-485 was after my fingerprints were taken. After my removal proceedings were dismissed, my lawyer sent the remaining documents to the TEXAS SERVICE CENTER. - TEXAS CSC kept rejecting my packet. - Finally, on January 30, 2024, my lawyer emailed me saying, "I was able to get an infopass and went there. The I-485 is now lodged. It would take approximately 90 days for them to review and determine whether they will still conduct a marriage interview or not. It is also possible they will request a new medical exam. If they decide not to conduct an interview and instead ask for documents, they will issue the green card." On May 15, 2024, I submitted an E-request through the USCIS website. They responded, "A review indicates that your removal proceedings have been terminated or dismissed by an Immigration judge. USCIS now has jurisdiction to adjudicate your adjustment of status application. We have requested your file and will resume processing of your application." On July 10, 2024, I submitted another E-request. The response was, "Your application is currently pending. We regret that we are not able to provide you with a specific timeframe." I am also very frustrated with my lawyer because she absolutely doesn't care. She does not update me or provide a game plan. I tried reaching out to the district representative, and when I informed my lawyer, she became upset. I need your help, guys. I am absolutely losing hope.

lawyers are useless for anything other than filling out paperwork. have you tried to sue? are you out of processing time based on your 485 filing date? it’s expensive but it works quickly.

@w s 🇨🇦🇺🇸 my lawyer filled my I-485 last Feb 2020 but USCIS cannot do anything since I was still under removal proceedings but my case was dismissed June 23, 2023 last year

so what is the problem you need help with? you’ve been waiting 1 year because that’s when removal proceedings cancelled? it’s pretty standard to wait a year. I have a straight forward case and am at 13 months of waiting now. I hope you get lucky because it looks like a long road you’ve been on.

lawyers only help with paperwork and interviews unless they have connections then theres nothing they can do you are right on track with timeframe you’re one step closer to finally getting your green card

try to file I-131. sometimes it work to push ur I-485 to get approved. I was on the same situation like u. did ur lawyer file I-485 with court or with USCIS ? if its with court, I think to refile with USCIS will be faster

@domino 23 filed with USCIS last feb 2020, my case got dismissed last yr 2023. She said we can file I-131 but she does not recommend it since my case my just recently dismissed. are approved already?

do it yourself. I filed I-131 just to trigger the reopen I-485 and it worked. I filed I-131 got approved 8 days later and the next day I-485 reopened (by USCIS since I never I-485 with court). look on my profile I posted it all

@M E. if your I-130 was approved and the judge terminated your removal proceeding, you are no longer under court jurisdiction to adjust your I 485. Texas service center in Irving is for those that want to adjust their status in immigration court, so the court would want you to send a copy to Texas service center and another copy of your I 485 to the court for the judge to process. But since you had terminated your deportation proceedings, you do not need to file any I 485 with the Texas service center anymore. All you need to do is to file a fresh I 485 to the USCIS in the zone your state falls under. Your lawyer should have known that the Texas service centre in Irving is for only those that want to adjust their status before an Immigration judge in deportation proceedings.
