Hi all, I was main asylum applicant my wife was dependent. Last year we file 2 separate applications for green card at the same time. Both our cases were transferred to National Benefits Center. On February 1 her case status changed to FRE request was sent and it’s coming from San Francisco field office however we located in Maryland… my case status hasn’t changed since fingerprints were attached. any ideas what is going on?

@Stani K Nothing to worry about. It is actually a good news when you case gets transferred to NBC or local field office. The RFE should tell you what’s missing in your petion. I always encourage people to include the sealed medical envelope along with a copy of your I-94, showing proof of your asylum status when you apply for an adjustment of status. The burden of proof is on the applicants to prove they are who they are based on their legal status. The process can be further delayed when those preliminary items are missing from your apllication. You will be approved before the end of the summer if all goes well.

@E Hopeful I’m just curious why it’s only her case and why they didn’t send it to Maryland field office since we’re located here

@Stani K They can redirect it wherever they want to balance workload across field offices. But rest reassured that they will contact you if they want to see you person at the local field office regardless where it is as we speak. They can also approve it without an interview, which is more likely to be the case for the majority of folks.

by the way, once you respond to your RFE, you will get approved within 30 to 60 days max. So it all depends how soon you respond. any idea yet what’s the RFE ? it should be medical if not yet submitted. So you are at the last part of the adjudication process of your green card application. that said, I can smell your approval from here, pretty much in the next month or so if you timely respond to the RFE.

@E Hopeful received RFE for my wife’s application. Basically we missed question 1 in section 8 regarding participation of any military or political organization… they only need that answer

That’s a self inflicted delay. Your case will be approved without an interview otherwise they could have asked you respond to that question the day of the interview when the officer will go over the I-485 questions with you. So start celebrating !!!!

@Stani K Yes, just answer what is missing in their RFE. Once completed and received, you’ll be finally approved.

@Stani K Big Congrats to you and your wife!!! start celebrating because you’ll be greened as well in no time. Just trust the process. I am super happy for both of you. She’ll first get her approval notice in the mail by end of next week and then the week after next week, she’ll get her green card. Once you both get your GCs, please update the SS office with your new status (LPR). And if you like traveling, I encourage you apply for global entries as well.
