@D K Form I-140 was accepted. I am yet to receive the notice in the mail. I am leaning towards @KOE KOE pov because my priority date is not current.

form i765 was rejected because payment wasn’t included. mine was rejected initially when I filed concurrently. I later included the payment and resent and it was finally denied and the reason was “at the time of filing the i765, there was no evidence that I was a beneficiary of an approved i140”. I’ll advice you to get your i140 approval first before filing the i765 to prevent you from losing the $400.

I filled i140, i485 and i131

@Michael Cliff yes. since you’re EB1, I believe your case maybe adjudicated quicker and you can file for your work authorization afterwards. that’s just my opinion.

As far as I know, you need to pay 1 check for $700 for i-140 and another check for i-485 ( once you submit i-485, i-765 and i-130 together their fees gets waived). another thing, I remember got two consecutive rejections for i-485 with a letter says that my payment is not correct (which is not true) with my case around 20 other cases got the same letter for no reason. so there’s a good chance that you only need to resubmit.

@John Snow thanks. when you resubmitted, did they approve your I-765 or rejected it again. how long did it take and was your PD current?

They approved both i765 and AP. still waiting on i-485.

@Michael Cliff Like I said in my earlier post, you cannot file Form I-140 together with I-485 when dates are not current for you. your I-140 will be accepted while the rest will be returned. A cool way to return your package without any question is to reject it. However, you can file I-485 and other documents (I-765 and I-131) when your PD becomes current.

I refiled my I-485 and I-765 and both has been accepted even though my PD is not current. Does this mean anything? Does it mean that they are tilted to approving my I-140?
