I-290B motion dismissed/ Need to reapply
my motion to reopen/reconsider my NIW was dismissed last week. I’m yet to receive the mail. I called USCIS and the agent said what it means is just file a new application. I just need some helpful thoughts with refilling.
Can I use the previous templates and petition with the new information that was rejected from my RFE?
Do I need to get new letters of recommendation etc?
I’ve not been able to reach my attorney as he’s not picking calls or responding to my emails. His office is not reachable as well.

hi @Pop_me L ! I’m sorry about it! you can apply again with the same project but taking in account the RFE facts that the officer refused! how long did it take for this decision? I’m waiting for the result of my appeal too!

@Ginet C. thank you. My initial application was in April 2022, RFE was January 2023. Denied June 2023. Motion was July 2023. It took 11 months to get this dismissal response.

@Pop_me L Do you currently have AOS pending? if yes, will you still have it if you refile?

I still have my AOS pending but don’t know what will happen to it at this time. I wish someone who has gone this route before would be willing to provide some insight.
