I-140 denied appealing but need to travel abroad.
hello, my I-140 case was denied but we are on a appealing process. we need to travel abroad but we are scared that even with our advance parole travel permit we could be denied the re entry to the us. has anyone done this before? please let me know. I know that the AP is linked to the i-485, which is still pending but our i-140 is still on denial and appealing process.

You must only travel after you have received the receipt notice of your appeal filed to AAO. Otherwise, you would be denied entry. I was in the same shoes, first case got denied in January, I was contemplating when a buddy told me he was outside the US returning from the UK when he suddenly got notification that his case had been denied, he tried to rush in but CBP at Airport checked his status, saw the denial and deprived him entry despite his AP. They actually retrieved all the cards and documents from him at the airport and put him on a plan back, he had to return to the UK from where he filed his appeal. so, file an appeal and wait to have the receipt notice before using the AP, that's what confirms your AOS
