I-140 approved after refilling. What’s next?
EB-2 NIW: Our I-140 was denied back in 2020 after the RFE. We refiled (same category) and used the same concurrent I-485s that we filed in 2018. USCIS approved and shipped our combo card renewals few weeks before the I-140 was approved. I have two questions: how long to process the I-485 in Texas and if I should be worried about eventually leaving the States, even with the travel parole and return, considering that I refiled. Thanks!

did you use the same i-485 application that you submit with your denied i-140? in my understanding, the i-485 will be automatically denied since the i-140 is denied.

Yes, it was the same and they posted an update for the I-485 a few days after informing that “case was updated to show fingerprints”.

It was very generic, informing that we can’t prove the benefits that my wife (the applicant) would provide to the United States. She’s a very experienced professional, university professor, three specializations, etc. The whole political ambiance wasn’t good and our lawyer did a lot of mistakes.

Opala 41. let me understand better. You had a denied 140 and refile using the same 485.pending for the new 140? it worked? Do you received the GC? I'm in the same situation. Thank you

Ana, yes. it’s something called “portability”. My lawyer wrote a letter to USCIS and they reused the 485s, all were updated and the “reused fingerprints” info was added to them when they accepted the new 140. I-140 was approved four months ago, I’m still waiting for the 485 processing. Our combo cards were renewed in the period successfully.

Hello Opala, when you refile your i140, did you answer the question in the form i140 asking if you have ever filled for an immigrant visa petition before? I want to refile and i am not sure if I should answer Yes or No because my previous i140 was denied.
