hi!!! I applied the same day than you and I was approved the same day than you too what next steps are you going to take since some people said the priority date it’s not current to file for I-485 ? however on the letter I received doesn’t said anything about priority dates it only said I need to apply for the I-485.

@Maria Tello It won’t say anything about priority date in I-140 approval notice. you need to see visa bulletin coming each month. As of Latest December visa bulletin, only priority dates before 1 January 2023 can apply for I-485 AOS.

@Michael Scott, yes that’s what I see, so you are just going to wait until the priority date it’s current? I’m just so stressed because my previous I-140 was denied therefore my current-I485 it’s also going to get denied and my lawyer said I have 180 days from the time my previous I-140 was denied to leave the country however I have my work authorization until May 2024, I don’t want to leave my job. and I do know how long it’s going to take to be current.

@Maria Tello yours is a very delicate situation. Nobody knows when the visa bulletin will move forward and one’s PD become current. Work authorization is based on pending I-485 and when you get denial decision on first I-485, you will lose your work authorization immediately( although it is valid until May 2024). Best case scenario will be you get denial after you apply for second I-485. For the worst case scenario, you will have to do Counselor processing.
It’s best to discuss with a good lawyer ASAP to know your options. I think you can also apply for I-765 for emergency purposes. If your EAD becomes invalid due to first I-485 denial, you might be able to apply for emergency I-765. I don’t know much about it but you can talk to your lawyer

@Michael Scott thank you so much for taking the time to review my question and answered, you are right at least I have different options, apply consulate, go back to school and safe some time, also today I called USCIS and they told I can send a letter asking to match my previous I-485 with the new approved I-140 so I will try everything and see what works. but thank you again .

Hi Maria, congratulations on the approval!
my plans is to wait 485 to be become current, and prepare the forms in the meantime. I recently got a job offer willing to submit a EB1 petition, but I'm not starting until July 2024. If EB2NIW is not current by May/June 2024, I will do EB1.
