Good day everyone. April 2, 2021 my husband’s petition got approved. I can’t file for an adjustment of status because I need to have a waiver for my two-year home residency requirement. And up to today, I am still waiting for its (waiver) approval. My question is, does an approved I-130 expire? It wasn’t forwarded to the NVC since we stated that I will adjust my status here in the US. Thank you.

if there is no action on an approved I-130 for 2 years, it expires. if you are applying for 212(e) waiver, it takes about 12-16 weeks to process depending on the waiver grounds. No objection statements are easier than the other categories bit it depends on whether your country grants NOS

Thank you very much. I filed an NOS to my home country and after 6 months of waiting, they denied my application. Now I am filing for an Exceptional Hardship Waiver for my cancer survivor husband. I’m worried that we might file another I-130 since it will be a year since it was approved on April 2 of last year.

Good evening i am waiting for my Beneficary i 129 fiance till yet i did not received her interview letter or biomatrics.Its being 9 months.How long it will take?? Beneficary name is Sumaira Farooq. Waiting for a good news.
