how long do you guys think it has to be in order to do a writ of mandamus to sue USCIS. because it’s taking forever in my case it’s been more then a year.

It must be outside of normal processing times for your I-130 in your Service Center. You can check online processing times. If it is outside, your attorney can file a mandamus which will oblige them to reach a decision within 60 calendar days.

my case was in Nebraska and then they transferred to Texas and then they transferred to Potamac.. and I’m afraid they’re going to transfer to California cause that means another year of waiting… I have 10 days till my case it’s outside the normal processing time. and I’m going to file a inquiry but if they tell me that my case was transferred to California I want to do a writ of mandamus. cause they’re just transferring my case and not doing anything to get aprroved

@just curious, do you have an attorney on file ? I’ve heard a lot of case transfers, but usually they transfer it either to your jurisdiction (where you live) or to a service center with a smaller line. I hope it will settle at Potomac so you’ll be able to do an inquiry
