@Asma long story short, USCIS asked for solid proof that our marriage is ābona fide beyond reasonable doubtsā. The burden was on us to prove that our marriage is not a fraud because I was under removal proceedings. Our immigration Lawyer suggested to leverage combined finances as a proof because we do not have any kids together.

@Asma it means we must convince USCIS that there is no other reasonable explanation that can come from the evidence presented in the initial application and RFE.

Hi @abc similar case only that I have been waiting for 130 approval for almost 3 years. No interview, no RFE. Has your Removal proceeding been cancelled, mine got canceled in April. Any advice? Thanks

@ Asma we have called numerous times and they keep saying they are working on it, that decision has just not been made

@Ms Bells my removal proceeding has not been dismissed yet. my asylum case was administratively closed in 2014. We scheduled master hearding with IJ based on approved I-130. Are you working with an attorney who has dealt with cases similar to yours? if not, hire one. My additional advice would be to keep checking āUSCIS case processing timeā. Inquire about your case if itās outside normal processing time. Thatās what I had to do. Visit egov.uscis/processing-times/

@Asma I might be misunderstanding your question but I wanted to highlight that our I-130 has been approved based on the RFE we provided. My attorney filed motion to re-open my removal proceding case based on approved I-130. my attorney will try to get me PR through Immigration Court, rather than asking IJ to dismiss my removal proceedings and filing with USCIS.

@abc, did you continue to renew your EAD based on asylum even while you reopened your removal proceedings based On I-130?

@bina I hired an attorney to help me through this process. It looks like my attorney filed motion to reopen the case after my I-130 got approved. my attorney also submitted I-485 with I-765 to USCIS EOIR branch (I think?). I am assuming my next work authorization card will have C09 category on it.
