i-130 approved but we have to file I-824
Hey Guys,
i-130 Form PD: 02 April 2022. California Service Center - Submitted online (IOE).
First Active Review 5 May 2023.
Second Active Review 10 May 2023
We got approved on 11 May 2023.
but we saw the approval notice in the documents tab that we have to file I-824 form because of a mistake we have done in the form. We filled both adjustment of status and consular processing in the i-130.
Has anyone done this before and how much longer do we have to wait for the I-824 to be processed and then sent to NVC?

I committed same mistake as yours is making me waiting for an approval since June. file your form and be patient. there still a long road ahead of you. expect to wait for another year or so. good luck

same happens to me now I have to wait forever to get approved. it takes 3 to 6 month to get approved or more

This is what they had mentioned in the approval notice
“The above petition has been approved. However, you indicated on the petition that the beneficiary intends to apply for an immigrant visa abroad at a U.S. Embassy or a U.S. Consulate and will also apply for adjustment of status in the United States. Since you have indicated both options, USCIS has retained the petition.”
Also
“ If the beneficiary decides to apply for an immigrant visa outside the United States based on this petition, you should file Form I-824, Application for Action on an Approved Application or Petition, to request that we send the petition to the U.S. Department of State National Visa Center (NVC)”

I just don’t understand why they couldn’t just send an RFE to correct this instead of filing all over again and paying another $465 and waiting forever

I hope you don’t wait to file i824 form, i130 got it approved at California so your i824 will probably be at California center so expect 3 to 5 months.

@yasser ezer being a US citizen or not does have anything to do with this form. he just need to file his form and keep praying everyday to get approved. I am a US citizen and I have been waiting for almost 11 months to get this approved and forwarded to nvc.
