I-130 approve.
if my i130 is approved what do I do next? I’m filling for my husband and I’m a green card holder they said I should wait on my interview date but shouldn’t I file a i485 form?

it took me about 2 month it’s been approve since March 2020 but when I check case number it says waiting for interviews date and no action needed so I’m confuse if I should file another form or just wait on them?

they told us all fees and documents r complete and just waiting on interview date in august 2021 was the last update

@ trish: after an approved i130, next step is either adjustment of status i485 if husband is in the country or consular processing if he his abroad… have you started either of that process? if you have not you should definitely reach out to whoever told you to just wait for interview for clarity or contact uscis for next steps urgently

uscis told me to wait for interviews and that everything was approve miteb I did file the i485 and just don’t remember

@AG .. yes you can file i130 and i485 concurrently at any time if petitioner is a us citizen but if permanent resident (a visa must be available from bulletin dates to file concurrently)

my husband is a US citizen and we filed I-130 online and it said we should wait for a visa number to become available before we can go any further, we cannot file I-485

@Trish Morris: This is not clear. Did they send you an approval letter for I-130 or they just said it looks good and to wait for an interview? From what you’re describing, it doesn’t appear that your I-130 has been approved. As already stated by others, if you have an approval letter for I-130 and your spouse is abroad, then you proceed with consular processing. If your spouse is in the US, then you file I-485 AOS.

Yes, there’s no need to wait for an interview slot. Proceed with consular processing. There may be a backlog for interview opportunities but if you don’t start, you will not get on the queue for that.

@trish when was i130 approved? am hoping it’s not been more than a year as it seems you have not done anything since you got approval. usually once i130 is approved (you would have indicated in the i130 you wanted consular processing at an embassy abroad). you get follow up emails from uscis and nvc telling you how to process further and pay fees to process further .. check your emails for any communication from NVC

@ T W W, are you in the country or abroad? this matters as you can only file i485 if you are in the country. if you are in the country then there are always visas available for immediate family members of us citizens . if you are abroad however then obviously you can’t file i485 at same time

@Trish yes I am in the country, but the noticed after the online i130 specifically said I should wait extract from my notice 👉If this case is an I-130 Petition - Filing and approval of a Form I-130, Petition for Alien Relative, is only the first step in helping a relative immigrate to the United States. The beneficiaries of a petition must wait until a visa number is available before they can take the next step to apply for an immigrant visa or adjustment of status to lawful permanent residence. To best allocate resources, USCIS may wait to process I-130 forms until closer to the time when a visa number will become available, which may be years after the petition was filed. Nevertheless, USCIS processes I-130 forms in time not to delay relatives’ ability to take the next step toward permanent residence once a visa number does become available.

@FolaA this is my last update in aug2021 so do I just wait? This notice is to inform you that your case for an immigrant visa is documentarily complete at the National Visa Center (NVC) and has been since 14-Oct-2020. NVC has received all of the fees, forms and documents required prior to attending an immigrant visa interview. Your petition is awaiting an interview appointment. At this time, no further action is required. We appreciate your patience. Your case will remain at NVC until an appointment is scheduled, at which time we will send it to the appropriate U.S. Embassy or Consulate General. @ Trish: are you the only person processing this petition? i mean is your lawyer/spouse/family member assisting with this because from the message you just posted, it seems payments have been made and documents sent to nvc and all that is left is a visa appointment from the consular abroad. and if that’s the case then there is nothing else for you to do but just wait for the consular in your spouses country to invite him for the interview. the confusion here is you made it sound like you received the approval for your i130 and did nothing but the message you just posted indicated several other steps have been taken after that approval was issued. note that nvc notifies petitioner/beneficiary/attorney(if you have one) about processing so speak to either of those people about what they processed if you don’t know

@ TWW: the message you posted from your uscis notice does not contradict concurrent filing. reviewing applications on time or late is at uscis disgression and when they review your i130 they will also review your i485 if you were eligible. otherwise you would wait for an approval for i130 then file i485 and begin to wait again which you don’t have to do. consult with a lawyer if you can still send your i485 as am not sure of that and you can check online for lot of information about eligibility to file concurrently which on face value it seems you meet see below Concurrent filing is a term used when an immigrant petition and the adjustment application is filed at the same time along with the filing fees and supporting documentation. The Petition for Alien Relative, Form I-130, and the Application to Register Permanent Residence, Form I-485, may be filed concurrently if you are already in the U.S. and meet certain eligibility guidelines. If you apply for a Green Card while in another country and you have to go through consular processing, you will not be able to file the forms at the same time. This is because, in the case of consular processing, your forms go to both the Department of State and the USCIS.
