How to Answer the Yes/No Question on Unauthorized Work if You’ve Worked Without Authorization for 60 Days
Hi everyone, I’m in the process of completing my I-485, and I’m a bit unsure how to answer the yes/no question regarding unauthorized work. I previously worked without authorization for about 60 days, and I’m concerned about how this could impact my application. • Should I answer “yes” and provide an explanation? • How might this affect my green card process? • Are there any exemptions or considerations I should be aware of, especially for unauthorized work that occurred in the past? I’d appreciate any advice from those with similar experiences or legal insight into how to best approach this! Thanks in advance!

@Lena h So does that mean the INA 245(K) less than 180 days exemption does not apply?

@olu mikk You have to mark Yes as that's the truth. Then explain it in the end of the form. As you are employment based, any violation including unauthorized employment, out of status less than 180 days will be automatically forgiven due to 245(k). That's the law. What others are saying isn't correct.

@Lena h please read this line in your shared link: Employment-based applicants also may be eligible for exemption from this bar under INA 245(k).[9]
