Assuming that you come from the “All other Regions,” the current priority date is February 1, 2008. Therefore, anyone who has submitted their I-130 on or before that date can submit the I-485.

@Adam T the i130 was approved and the case was sent to nvc but now he is in the us under humanitarian parole. I was wondering if I can go ahead and apply for I485 and ask nvc to transfer his case to the us.

@lili e I have no idea in this case. I know in general, humanitarian parole does not provide a pathway to permanent residence or citizenship on its own. It is a temporary measure that allows individuals to stay in the U.S. for a limited period and for specific purposes. The terms and conditions of humanitarian parole are determined by the U.S. Department of Homeland Security on a case-by-case basis. I might be wrong, but I do not believe that would allow him to adjust his status based on none current priority date. Hopfully someone went through this process can shed some light. I would recommend speaking with an attorney! good luck
